These Terms of Service ("Terms") govern the relationship between The Chosen Agency ("Agency", "we", "us") and creators who engage our management services ("Creator", "you"). By signing an onboarding agreement, granting account access, or otherwise engaging our services, you agree to these Terms in full.
These Terms apply alongside any written onboarding agreement or management contract signed between the Agency and the Creator. In case of conflict, the written contract takes precedence.
The Chosen Agency provides OnlyFans and Fansly management services, which may include but are not limited to:
The specific services provided will be agreed upon during onboarding. We reserve the right to adjust our service offering with reasonable notice. We do not create content on behalf of creators, and all content uploaded to your platforms remains your sole property and responsibility.
All services are performed in accordance with OnlyFans and Fansly platform policies. We do not perform any actions that violate platform terms of service. You are responsible for maintaining compliance with platform rules on your own account.

The Agency operates on a performance-based revenue share. No upfront fees or monthly retainers are charged. Commission is calculated as a percentage of gross revenue generated on managed platforms:
Commission tiers are reviewed and adjusted monthly based on the previous month's gross revenue. Tier changes take effect from the first day of the following month. There are no retroactive adjustments.
Commission is deducted from platform payouts before transfer to the Creator, or invoiced monthly depending on the arrangement agreed during onboarding. Any disputes regarding commission calculations must be raised within 14 days of a payout.
All content created by the Creator — including photos, videos, voice notes, and written material — remains the exclusive intellectual property of the Creator. The Agency does not acquire any ownership rights to Creator content under any circumstances.
Any strategy documents, scripts, campaign materials, or templates created by the Agency specifically for a Creator's account are developed for that Creator's exclusive use during the term of management. These materials may not be used by the Creator to set up a competing agency business.
The Creator's stage name, persona, and brand identity remain the Creator's property throughout and after the management relationship. The Agency may not use the Creator's name, likeness, or brand for marketing purposes without explicit written consent.

This confidentiality obligation survives the termination of the management relationship indefinitely.
The Creator may terminate the management relationship at any time by providing 30 days' written notice to [email protected]. There are no exit fees, penalties, or minimum term requirements. During the notice period, the Agency will continue to perform services and commission on earnings during this period applies as normal.
The Agency may terminate the management relationship with 30 days' written notice. In cases of material breach of these Terms by the Creator (including non-payment, fraudulent activity, or violation of platform terms), the Agency may terminate with 7 days' notice.
The Agency provides management services on a best-efforts basis. We do not guarantee specific revenue outcomes. Past results referenced in our marketing materials are based on historical averages and are not a promise of future performance.
To the maximum extent permitted by law, the Agency's total liability to the Creator under these Terms shall not exceed the total commission paid to the Agency in the 3 months preceding the claim.
The Agency is not liable for platform-side issues, account suspensions imposed by OnlyFans or Fansly, changes to platform algorithms or policies, or events outside our reasonable control.
In the event of a dispute arising from these Terms or our management relationship, the parties agree to attempt resolution through good-faith negotiation first. If a dispute cannot be resolved within 30 days of written notice, the parties may escalate to mediation before pursuing legal proceedings.
These Terms are governed by and construed in accordance with applicable law. The parties submit to the non-exclusive jurisdiction of the courts for resolution of any disputes that cannot be settled through mediation.
We may update these Terms from time to time. Changes will be communicated to active Creators by email with at least 14 days' notice. Continued use of our services after the notice period constitutes acceptance of the updated Terms.
